TERMS AND CONDITIONS OF THE ONLINE STORE ROCKWORLD Carp Anglers' Shop operating under the domain www.ROCKOWRLD.pl as of January 30, 2015

I. Definitions
The following terms used in these Terms and Conditions shall mean:

1. Client – a natural person, legal person or an organizational unit without legal personality which is granted legal capacity by special provisions, making Orders within the Store;
2. Civil Code – Act of April 23, 1964 (Journal of Laws No. 16, item 93 as amended);

3. Terms and Conditions – these Terms and Conditions for the provision of electronic services within the online store www.rockworld.pl;
4. Online Store (Store) – an internet service available at www.rockworld.pl, through which the Client can, in particular, place Orders;
5. Goods – products presented in the Online Store;
6. Sales Agreement – a sales agreement of the Goods within the meaning of the Civil Code, concluded between ROCKWORLD Łukasz Pawlik and the Client, using the Store's internet service;
7. Consumer Rights Act – Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827);
8. Act on Providing Services by Electronic Means – Act of July 18, 2002 on providing services by electronic means (Journal of Laws No. 144, item 1204 as amended);
9. Order – a declaration of will by the Client, directly aimed at concluding a Sales Agreement, specifying in particular the type and number of the Goods.

II. General Provisions
2.1. These Terms and Conditions define the rules for using the online store available at www.rockworld.pl.
2.2. These Terms and Conditions are the regulations referred to in art. 8 of the Act on Providing Services by Electronic Means.
2.3. The online store, operating at www.rockworld.pl, is conducted by ROCKWORLD Łukasz Pawlik, with its registered office at 48-130 Kietrz, Kochanowskiego 21, NIP PL 7481388948, conducting business based on the entry in the business activity register under number 1573 conducted by the Mayor of Kietrz
2.4. These Terms and Conditions specify in particular:
a) the rules of registration and use of the account within the online store;
b) the conditions and rules for making electronic reservations of products available within the online store;
c) the conditions and rules for placing Orders electronically within the online store;
d) the rules for concluding Sales Agreements using the services provided within the Online Store.
2.5. Using the online store is possible provided that the client's teleinformation system meets the following minimum technical requirements:

a) Internet Explorer version 10.0 or newer with Java support enabled, or
b) Firefox version 26.0 or newer with Java support enabled,
2.6. To use the online store, the Client should independently obtain access to a computer station or terminal device with Internet access.
2.7. In accordance with applicable laws, ROCKWORLD Łukasz Pawlik reserves the right to limit the provision of services through the Online Store to persons who have reached the age of 18. In such a case, potential Clients will be informed thereof.

2.8. Clients can access these Terms and Conditions at any time via a link posted on the home page of the website www.rockworld.pl and download it and make a printout.
2.9. Information about the Goods provided on the Store's web pages, in particular their descriptions, technical and operational parameters, and prices, constitute an invitation to contract, within the meaning of art. 71 of the Civil Code.

III. Rules of using the Online Store
3.1. Registration within the Store is a precondition for using all functions of the online store.
3.2. Registration is carried out by filling out and accepting the registration form, available on one of the Store pages.
3.3. A condition for registration is the acceptance of the Terms and Conditions and providing personal data marked as mandatory.
3.4. Rockworld Łukasz Pawlik may deprive the Client of the right to use the Online Store, as well as may limit their access to part or all of the resources of the Online Store, with immediate effect, in case of a violation of the Terms and Conditions by the Client, and in particular when the Client:
a) provided untrue, inaccurate or outdated information during registration in the online store, misleading or violating the rights of third parties,
b) has infringed upon the personal rights of third parties through the online store, in particular the personal rights of other clients of the online store,
c) has engaged in other behaviors that will be considered by ROCKWORLD Łukasz Pawlik as incompatible with applicable laws or general principles of using the Internet or detrimental to the good name of ROCKWORLD Łukasz Pawlik.
3.5. A person who has been deprived of the right to use the online store cannot re-register without the prior consent of ROCKWORLD Łukasz Pawlik.
3.6. To ensure the security of messages and data transmission in connection with the services provided on the Website, the online store takes technical and organizational measures appropriate to the degree of threat to the safety of the services provided, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons.
3.7. The Client is particularly obligated to:
a) not deliver and not transmit content forbidden by law, e.g., content promoting violence, defamatory or infringing personal rights and other rights of third parties,
b) use the online store in a way that does not disrupt its functioning, in particular through the use of specific software or devices,
c) not undertake actions such as: sending or posting unsolicited commercial information (spam) within the online store,
d) use the online store in a way that is not burdensome for other clients and for ROCKWORLD Łukasz Pawlik.,
e) use all content posted within the online store only for personal use,
f) use the online store in a manner consistent with the laws in force in the territory of the Republic of Poland, the provisions of the Terms and Conditions, as well as with general principles of using the Internet.

IV. Procedure for concluding a Sales Agreement
4.1. To conclude a Sales Agreement via the online store, one should go to the webpage, make a selection by taking subsequent technical actions based on the messages and information available on the site displayed to the Client.
4.2. The Client's selection of ordered Goods is made by adding them to the basket.
4.3. During the process of placing an Order – until pressing the "Order" button – the Client has the opportunity to modify the data entered as well as the selection of Goods. To do this, follow the messages displayed to the Client and the information available on the site.
4.4. After providing all necessary data by the Client using the online store, a summary of the placed Order will be displayed. The summary of the placed Order will contain information about:
a) the subject of the order,
b) unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
c) selected payment method,
d) chosen method of delivery,
4.5. To send the Order, it is necessary to accept the Terms and Conditions, provide personal data marked as mandatory, and press the "Purchase Confirmation with obligation to pay" button.
4.6. Sending the Order by the Client constitutes a declaration of intent to conclude a Sales Agreement with ROCKWORLD Łukasz Pawlik, in accordance with the contents of the Terms and Conditions.
4.7. After placing the Order, the Client receives an email titled You have made a purchase in the ROCKWORLD.pl store, containing final confirmation of all essential elements of the Order.
4.8. The agreement is considered concluded at the moment the Client receives the email mentioned above.
4.9. The Sales Agreement is concluded in Polish, in accordance with the Terms and Conditions.

V. Delivery
5.1. Delivery of Goods is limited to the territory of the Republic of Poland and takes place at the address indicated by the Client during the Order process.

5.2. Delivery of the ordered Goods is carried out by courier or postal shipment. Delivery costs are provided in the delivery cost list which you can find here
5.3. The delivery time frame is from 1 to 3 business days from the day of sending the Order by the Client.
5.4. Clients can access these Terms and Conditions at any time via a link posted on the home page of the website www.rockworld.pl and download it and make a printout. The recording, securing, making available and confirming to the Client of the essential provisions of the Sales Agreement of the Goods takes place by sending an email to the given address and by including in the package containing the Goods a printout of the confirmation, Order specification, and VAT invoice.

VI. Prices and payment methods
6.1. Prices of Goods are given in Polish zloty and include all components, including VAT, duties, and all other components.
6.2. The Client has the option to pay the price:
a) by transfer to the bank account number 51 1140 2004 0000 3102 3558 4460,
b) by payment in the PayU system supporting quick payments and Visa and Maestro cards,
c) cash on delivery - paying the courier upon receiving the package
d) in the installment system supported by PayU Raty

VII. Right to withdraw from the agreement

You have the right to withdraw from this agreement within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us ROCKWORLD Carp Anglers' Shop, Stefana Batorego 8, 47-400 Racibórz, phone 883 474 729, email address: [email protected] of your decision to withdraw from this agreement by an unequivocal statement (e.g. a letter sent by post or email).

You may use the attached model withdrawal form, but it is not obligatory. You can also fill in and submit any other clear statement of your will to withdraw from the contract electronically.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

In the event of withdrawal from this agreement, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this agreement.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.

Please send back the goods to: ROCKWORLD Carp Anglers' Shop, Stefana Batorego 8, 47-400 Racibórz, phone 883 474 729, immediately and not later than 14 days from the day on which you communicate your withdrawal from this agreement to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

VIII. Complaints about Goods
8.1. ROCKWORLD Łukasz Pawlik as the seller is responsible towards the Client who is a consumer within the meaning of art. 22[1] of the Civil Code, under warranty for defects to the extent specified in the Civil Code.
8.2. Complaints resulting from the violation of the Client's rights guaranteed by law, or under these Terms and Conditions, should be addressed to [email protected]. The entity commits to consider each complaint within 14 days, and if that is not possible, to inform the Client within that period when the complaint will be considered.
8.3. ROCKWORLD Łukasz Pawlik is not the producer of the goods. The producer is liable for the warranty of the sold Goods on the terms and for the period indicated in the warranty card. If the warranty document allows for such a possibility, the Client may submit their claims under the warranty directly at the authorized service center, whose address is in the warranty card.

IX. Complaints regarding the provision of electronic services
9.1. ROCKWORLD Łukasz Pawlik takes actions to ensure the fully correct functioning of the Store, to the extent that results from current technical knowledge and commits to remove in a reasonable time all irregularities reported by Clients.
9.2. The Client is obliged to immediately notify ROCKWORLD Łukasz Pawlik of any irregularities or interruptions in the operation of the Online Store service.
9.3. Irregularities related to the functioning of the Store the Client may report in writing to the address: ROCKWORLD Carp Anglers' Shop, Batorego 8, 47-400 Racibórz, or via email to [email protected].
9.4. In the complaint, the Client should provide their name and surname, address for correspondence, the type and date of occurrence of irregularities related to the functioning of the Store.
9.5. ROCKWORLD Łukasz Pawlik commits to consider each complaint within 14 days, and if that is not possible, to inform the Client within that period when the complaint will be considered.

X. Final Provisions
10.1. Any disputes arising between ROCKWORLD Łukasz Pawlik and the Client, who is a consumer within the meaning of art. 22[1] of the Civil Code, shall be submitted to the courts in accordance with the provisions of the relevant Code of Civil Procedure.
10.2. Any disputes arising between ROCKWORLD Łukasz Pawlik and the Client, who is not a consumer within the meaning of art. 22[1] of the Civil Code, shall be submitted to the court proper for the seat of ROCKWORLD Łukasz Pawlik.
10.3. In matters not regulated in these Terms and Conditions, the provisions of the Civil Code, the Act on Providing Services by Electronic Means, and other appropriate Polish legal provisions shall apply.
