TERMS AND CONDITIONS "CONTEST+ Prologic DECEMBER"
1. GENERAL PROVISIONS
1.1. The Contest is organized by ŁUKASZ PAWLIK, conducting business activity under the company name ROCKWORLD ŁUKASZ PAWLIK, registered in the Central Registration and Information on Business of the Republic of Poland maintained by the minister competent for economic affairs, with the following details: business and service address: Jana Kochanowskiego 21, 48-130 Kietrz, Tax Identification Number (NIP) 7481388948, National Business Registry Number (REGON) 532429748, email: [email protected].
1.2. The Contest is organized in the Organizer's Online Store accessible at: www.rockworld.pl and in the Organizer's Brick and Mortar Store at: Mikołaja 9a, 47-400 Racibórz.
1.3. The Contest is open to individuals who express the desire to participate by registering for the Contest in accordance with the Contest Regulations.
1.4. Participation in the Contest and hence the provision of information and data by the Participant related to their participation in the Contest, including personal data, as specified in the Regulations, is voluntary but necessary for the proper conduct of the Contest.
1.5. The prize sponsor of the Contest is the Organizer.
2. DEFINITIONS:
2.1. The terms used in these Regulations shall mean:
2.1.1. CIVIL CODE – the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
2.1.2. CONTEST COMMITTEE – a committee appointed by the Organizer consisting of 3 persons to ensure the proper organization and conduct of the Contest, in particular to determine the Contest winner.
2.1.3. CONTEST – this contest organized by the Organizer in accordance with the Regulations.
2.1.4. ORGANIZER – ŁUKASZ PAWLIK, conducting business activity under the company name ROCKWORLD ŁUKASZ PAWLIK, registered in the Central Registration and Information on Business of the Republic of Poland maintained by the minister competent for economic affairs, with the following details: business and service address: Jana Kochanowskiego 21, 48-130 Kietrz, Tax Identification Number (NIP) 7481388948, National Business Registry Number (REGON) 532429748, email: [email protected].
2.1.5. REGULATIONS – these Contest Regulations.
2.1.6. ONLINE STORE - the Organizer's online store available at the internet address: www.rockworld.pl.
2.1.7. BRICK AND MORTAR STORE – the Organizer's brick and mortar store located at: Mikołaja 9a, 47-400 Racibórz.
2.1.8. PARTICIPANT – an individual who participates in the Contest and additionally meets the requirements specified in section 3 of the Contest Regulations.
2.1.9. CONTEST TASK – the contest task to be completed by the Participant, which consists of answering the question: "My favorite Prologic product is... because...." during placing an order in the Online Store or during a purchase in the Brick and Mortar Store.
3. CONDITIONS FOR PARTICIPATION IN THE CONTEST
3.1. Participation in the Contest is voluntary and free of charge.
3.2. Entry into the Contest is done by purchasing any Prologic branded products, indicating consent to participate in the contest and by completing the Contest Task by the Participant during placing an order in the Online Store or during a purchase in the Brick and Mortar Store.
3.3. The Contest Task must be completed independently by the Participant, it must be an original work that has not been previously published, including on the Internet. Participants, when submitting and sending the Contest Task to the Organizer, must have full personal and property copyright.
3.4. The Participant, especially in connection with the completion and submission of the Contest Task, is prohibited from providing unlawful content. Content provided by the Participant, especially within the Contest Task, should comply with the law and good manners, taking into account respect for personal rights and copyright and intellectual property of the Organizer and third parties, and should not contain vulgar, offensive language, or violate the rules of social coexistence.
3.5. Excluded from participation in the Contest are employees and associates of the Organizer and other persons who participated in the preparation or organization of the Contest as well as members of their immediate families. Immediate family members are defined as: ascendants, descendants, siblings, spouses, parents of spouses, and persons in an adoption relationship.
4. CONDITIONS AND RULES OF THE CONTEST
4.1. The Contest runs from December 19, 2023, to January 20, 2024.
4.2. To select the Contest winner and ensure the proper course of the Contest, the Committee will freely choose the winning Contest Task, based on their own judgment, considering relevance, compliance with the Contest theme, originality, and interest of the Participant's Contest Task.
4.3. There will be 1 winner selected in the Contest, who will be awarded a prize by the Contest Committee consisting of a Prologic Avenger 6000 BF Carp Reel TF Handle reel with a retail value of 221.00 PLN.
4.4. The Contest results will be announced within 14 days from the end of the Contest by publishing the relevant information in the appropriate tab of the Organizer's Online Store. In addition, the winner will be informed of the victory by the Organizer via an email sent to the address provided by them or by phone.
4.5. In the event that the Organizer is unable to obtain the data necessary to deliver the prize to the Participant or in case of no response to the message sent to the Participant by the Organizer, the Committee has the right to choose an alternative Participant who will be awarded the prize.
4.6. The Organizer will contact the winner immediately, but no later than within 14 days from the end of the Contest.
4.7. The winner may waive the right to the awarded prize; however, they may not transfer the right to the prize to a third party, or demand an exchange of the prize for a monetary equivalent or any other form of compensation.
4.8. The prize will be delivered to the Contest winner by courier to the address provided by them within 21 days from the announcement of the Contest results at the expense of the Organizer.
4.9. If the prize is subject to taxation, the Contest winner will be awarded (added) an additional cash prize equal to the tax amount that the Contest winner is obliged to pay due to the victory in the Contest. The additional cash prize mentioned in the previous sentence is non-refundable and will be used to cover the lump sum tax as referred to in Article 30(1)(2) of the Act of July 26, 1991, on personal income tax (consolidated text: Journal of Laws of 2018, item 1509, as amended). This tax will be deducted by the Contest Organizer and paid to the relevant tax office.
5. PRIVACY POLICY
5.1. The Data Controller of the personal data processed in connection with the implementation of the provisions of these Regulations is the Organizer (hereinafter referred to as the "Controller"). Personal data are processed in accordance with applicable law, in particular, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – referred to as "GDPR" or "GDPR Regulation".
5.2. The Controller processes personal data for the purposes, for the period, and based on the principles indicated in this section of the Regulations. Providing personal data is voluntary, but failure to provide the personal data necessary to take advantage of the Contest results in the inability to participate in it. The Controller takes special care to protect the interests of the persons whose personal data it processes, and in particular, it is responsible for and ensures that the collected data are: (1) processed lawfully; (2) collected for specified, lawful purposes and not further processed in a way incompatible with those purposes; (3) factually correct and adequate in relation to the purposes for which they are processed; (4) stored in a form which permits identification of the persons they concern, for no longer than is necessary to achieve the purpose of processing; and (5) processed in a way that ensures adequate security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, by appropriate technical or organizational measures. Considering the nature, scope, context, and purposes of processing as well as the risk of violation of the rights or freedoms of natural persons with different likelihood and severity, the Controller implements appropriate technical and organizational measures to ensure that the processing complies with this Regulation and to be able to demonstrate this compliance. These measures are reviewed and updated as necessary. The Controller applies technical measures to prevent unauthorized persons from acquiring and modifying personal data transmitted electronically.
5.3. The Controller is entitled to process personal data in cases where – and to the extent that – at least one of the following conditions is met: (1) the person concerned has consented to the processing of their personal data for one or more specific purposes; (2) processing is necessary for the performance of a contract to which the person concerned is a party, or to take action at the request of the person concerned before entering into a contract; (3) processing is necessary to fulfill a legal obligation incumbent on the Controller; or (4) processing is necessary for the purposes resulting from legally justified interests pursued by the Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the person concerned requiring the protection of personal data, in particular when the person concerned is a child.
5.4. Processing of personal data by the Controller always requires the occurrence of at least one of the bases indicated above. Specific grounds for the processing of personal data of Participants by the Controller are indicated in the next section of the Regulations – in relation to the specific purpose of processing personal data by the Controller.
5.5. The Controller may process personal data for the following purposes, on the following legal bases, and for the following periods:

Data is stored for the period of the existence of the legitimate interest pursued by the Controller, but no longer than the expiration of the Controller's claims against the person concerned related to the Controller's business activity. The prescription period is determined by legal provisions, in particular the Civil Code (the basic prescription period for claims related to conducting business activity is three years). The Controller cannot process data for direct marketing purposes if an effective objection has been expressed in this regard by the person concerned. |

5.6. It is necessary for the Controller to use the services of external entities. The Controller uses only the services of those processors who provide sufficient guarantees to implement appropriate technical and organizational measures so that the processing meets the requirements of the GDPR Regulation and protects the rights of data subjects. The Controller transfers data only when it is necessary to achieve a specific data processing purpose and only to the extent necessary to achieve it. Personal data of Participants may be transferred to the following recipients or categories of recipients:
5.6.1. service providers supplying the Controller with technical, IT, and organizational solutions, enabling the Controller to conduct business (in particular, suppliers of computer software for running a website, email and hosting providers, and suppliers of software for company management and providing technical support to the Controller) – the Controller shares the collected personal data of the Participant with the selected supplier acting on its behalf only in the case and to the extent necessary to achieve the data processing purpose compatible with this section 5 of the Regulations.
5.6.2. providers of accounting, legal, and advisory services providing support to the Controller in accounting, legal or advisory matters (in particular, an accounting office, law firm, or debt collection company) – the Controller shares the collected personal data of the Participant with the selected supplier acting on its behalf only in the case and to the extent necessary to achieve the data processing purpose compatible with this section 5 of the Regulations.
5.6.3. carriers / freight forwarders / courier brokers / entities handling the shipping process – in the case of the Contest winner, the Controller shares the collected personal data of the winner with the selected carrier, freight forwarder, or intermediary carrying out shipments on behalf of the Controller – to the extent necessary to deliver the prize to the winner.
5.7. Each person has the right to control the processing of data concerning them contained in the Controller's data set, and in particular the right to: request the completion, updating, correction of personal data, temporary or permanent suspension of their processing, or their deletion if they are incomplete, outdated, untrue, or have been collected in violation of the law, or are no longer necessary for the purpose for which they were collected.
5.8. The right to access, rectify, restrict, delete, or transfer – the person concerned has the right to request the Controller to access their personal data, rectify it, delete it ("the right to be forgotten") or restrict processing, and has the right to object to processing, as well as has the right to transfer their data. The detailed conditions for exercising the above rights are specified in Articles 15-21 of the GDPR Regulation.
5.9. The right to withdraw consent at any time – if the person's data is processed by the Controller on the basis of expressed consent (pursuant to Article 6(1)(a) or Article 9(2)(a) of the GDPR Regulation), then they have the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.
5.10. The right to lodge a complaint with the supervisory authority – the person whose data is processed by the Controller has the right to lodge a complaint with the supervisory authority in the manner and procedure specified in the provisions of the GDPR Regulation and Polish law, in particular the Act on the Protection of Personal Data. The supervisory authority in Poland is the President of the Office for Personal Data Protection.
5.11. The right to object – the person concerned has the right at any time to object – for reasons related to their particular situation – to the processing of their personal data based on Article 6(1)(e) (interest or public tasks) or f) (legitimate interest of the controller), including profiling based on these provisions. In such a case, the Controller may no longer process these personal data unless it demonstrates the existence of valid legally justified grounds for processing, overriding the interests, rights, and freedoms of the person concerned, or grounds for establishing, pursuing, or defending claims.
5.12. The right to object to direct marketing – if personal data is processed for direct marketing purposes, the person concerned has the right at any time to object to the processing of their personal data for such marketing, including profiling, to the extent that the processing is related to such direct marketing.
5.13. To exercise the rights mentioned in this section 5 of the Regulations, you can contact the Controller by sending an appropriate written message or email to the Controller's address indicated at the beginning of the Regulations.
6. COMPLAINT PROCEDURE
6.1. Complaints related to the Contest can be submitted by the Participant, for example, via email at: [email protected].
6.2. It is recommended to provide as much information and circumstances related to the subject of the complaint as possible in the description of the complaint, in particular the type and date of the irregularity and contact details – this will facilitate and accelerate the consideration of the complaint by the Organizer.
6.3. The Organizer's response to the complaint occurs immediately, no later than within 14 days from the date of its submission.
