TERMS AND CONDITIONS "CONTEST + JRC December"

1. GENERAL PROVISIONS

1.1. The Contest is organized by ŁUKASZ PAWLIK conducting business activity under the name ROCKWORLD ŁUKASZ PAWLIK, entered into the Central Registration and Information on Business of the Republic of Poland maintained by the minister responsible for the economy, having: business address and correspondence address: ul. Jana Kochanowskiego 21, 48-130 Kietrz, TAX ID (NIP) 7481388948, REGON 532429748, email address: [email protected].

1.2. The Contest is organized in the Organizer's Online Store available at: www.rockworld.pl and in the Organizer's Brick-and-Mortar Store at: ul. Mikołaja 9a, 47-400 Racibórz.

1.3. The Contest is open to any natural person who expresses the will to participate by registering for the Contest in accordance with the Contest Rules.

1.4. Participation of the Participant in the Contest and thus the provision of information and data related to their participation in the Contest, including personal data, the scope of which has been specified in the Rules, is voluntary, but necessary for the proper conduct of the Contest.

1.5. The prize sponsor in the contest is the Organizer.

2. DEFINITIONS:

2.1. The terms used in these Rules mean:

2.1.1. CIVIL CODE – the Act of April 23, 1964 - Civil Code (Journal of Laws No. 16, item 93, as amended).

2.1.2. CONTEST COMMITTEE – a committee appointed by the Organizer in the number of 3 persons to ensure the proper organization and course of the Contest, in particular to determine the winner of the Contest.

2.1.3. CONTEST – this contest organized by the Organizer in accordance with the Rules.

2.1.4. ORGANIZER – ŁUKASZ PAWLIK conducting business activity under the name ROCKWORLD ŁUKASZ PAWLIK, entered into the Central Registration and Information on Business of the Republic of Poland maintained by the minister responsible for the economy, having: business address and correspondence address: ul. Jana Kochanowskiego 21, 48-130 Kietrz, TAX ID (NIP) 7481388948, REGON 532429748, email address: [email protected].

2.1.5. RULES – these Contest rules.

2.1.6. ONLINE STORE - the Organizer's online store accessible at the website: www.rockworld.pl.

2.1.7. BRICK-AND-MORTAR STORE – the Organizer's brick-and-mortar store located at: ul. Mikołaja 9a, 47-400 Racibórz.

2.1.8. PARTICIPANT – a natural person participating in the Contest who additionally meets the requirements indicated in section 3 of the Contest Rules.

2.1.9. CONTEST TASK – a contest task that the Participant must perform, consisting of the response to the question: "My favorite JRC brand product is... because... " during placing an order in the Online Store or while making a purchase in the Brick-and-Mortar Store.

3. CONDITIONS OF PARTICIPATION IN THE CONTEST

3.1. Participation in the Contest is voluntary and free of charge.

3.2. Participation in the Contest is registered by purchasing any JRC branded products, agreeing to participate in the contest, and performing the Contest Task by the Participant while placing an order in the Online Store or while making a purchase in the Brick-and-Mortar Store.

3.3. The Contest Task should be performed independently by the Participant, be an original work, which has not been previously published, including on the Internet. The Participant performing and submitting the Contest Task to the Organizer is obliged to have full personal and property copyright.

3.4. The Participant, in particular in connection with the performance and submission of the Contest Task, is prohibited from providing unlawful content. Content provided by the Participant, especially as part of the Contest Task, should comply with the law and good manners, considering the respect for personal rights and copyright and intellectual property rights of the Organizer and third parties, and should not contain vulgar, offensive language or violate social cohabitation rules.

3.5. Employees and associates of the Organizer and other persons who participated in the preparation or organization of the Contest as well as members of their immediate family are excluded from participation in the Contest. Immediate family members include: ascendants, descendants, siblings, spouses, parents of the spouses, and persons in an adoptive relationship.

4. TERMS AND CONDITIONS OF THE CONTEST

4.1. The Contest runs from December 18, 2023, to January 19, 2024.

4.2. To select the winner of the Contest and to ensure the proper course of the Contest, the Commission will freely choose the winning Contest Task, based on their own discretion, considering the relevance, compliance with the Contest theme, originality, and interestingness of the Participant's Contest Task.

4.3. The Contest will select 1 winner, whom the Contest Committee will award a prize in the form of a JRC RV 7000 reel with a retail value of 265.00 PLN.

4.4. The Contest results will be announced within 14 days from the end of the Contest, by publishing relevant information in the appropriate section of the Organizer's Online Store. Additionally, the winner will be informed about the win by the Organizer via an email message sent to the address provided by them or by telephone.

4.5. If the Organizer is unable to obtain the data necessary to send the prize to the Participant or in case of no response to the message sent to the Participant by the Organizer, the Commission has the right to choose an alternative Participant to whom the prize will be awarded.

4.6. The Organizer will contact the winner immediately, but no later than within 14 days from the end of the Contest.

4.7. The winner may waive the right to the prize, however, they may not transfer the right to the prize to a third party, or request the exchange of the prize for a cash equivalent or any other form of compensation.

4.8. The prize will be delivered to the winner of the Contest by courier to the address provided by them within 21 days from the date of announcing the Contest result at the cost of the Organizer.

4.9. If the prize is taxable, the Contest Winner will be awarded (added) an additional cash prize in the amount of the tax equivalent that the Contest Winner is obliged to pay due to the win in the Contest. The additional cash prize mentioned in the previous sentence is not subject to issuance and will be used to cover the flat-rate tax referred to in Article 30 (1) point 2 of the Act of July 26, 1991, on personal income tax (Journal of Laws of 2018, item 1509, as amended). This tax will be deducted by the Contest Organizer and paid to the appropriate tax office.

5. PRIVACY POLICY

5.1. The data controller of the personal data processed in connection with the implementation of the provisions of these Rules is the Organizer (hereinafter referred to as the "Administrator"). Personal data are processed in accordance with the applicable legal provisions, in particular in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter referred to as "GDPR" or "GDPR Regulation".

5.2. The Administrator processes personal data for the purposes, for the period, and based on the principles indicated in this section of the Rules. Providing personal data is voluntary, but the failure to provide personal data necessary to participate in the Contest results in the inability to take part in it. The Administrator takes special care to protect the interests of the persons whose personal data he processes, and in particular is responsible and ensures that the data collected by him are: (1) processed lawfully; (2) collected for specified, lawful purposes and not subject to further processing inconsistent with these purposes; (3) factually correct and adequate in relation to the purposes for which they are processed; (4) stored in a form enabling identification of the persons to whom they relate, for no longer than is necessary to achieve the purpose of processing, and (5) processed in a way that ensures adequate security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures. Taking into account the nature, scope, context, and purposes of processing as well as the risk of infringement of the rights or freedoms of natural persons with different probability and severity of the threat, the Administrator implements appropriate technical and organizational measures so that the processing complies with the GDPR and can demonstrate this. These measures are reviewed and updated if necessary. The Administrator uses technical measures to prevent unauthorized persons from acquiring and modifying personal data transmitted electronically.

5.3. The Administrator is authorized to process personal data in cases where - and to the extent that - at least one of the following conditions is met: (1) the person to whom the data relate has consented to the processing of their personal data for one or more specified purposes; (2) processing is necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject before entering into a contract; (3) processing is necessary to fulfill a legal obligation incumbent on the Administrator; or (4) processing is necessary for the purposes arising from legally justified interests pursued by the Administrator or by a third party, except for situations where the paramount character against these interests have the interests or fundamental rights and freedoms of the data subject requiring protection of personal data, in particular when the data subject is a child.

5.4. The processing of personal data by the Administrator requires the occurrence of at least one of the bases indicated above each time. Specific bases for the processing of personal data of Participants by the Administrator are indicated in the next section of the Rules - in relation to a specific purpose of processing personal data by the Administrator.

5.5. The Administrator may process personal data for the following purposes, on the following legal bases, and for the following period:

The data is stored for the period of existence of the legally justified interest pursued by the Administrator, but no longer than the period of limitation of claims by the Administrator against the person to whom the data relate, on account of the Administrator's business activity. The limitation period is determined by legal provisions, in particular the Civil Code (the basic limitation period for claims related to conducting business activity is three years).

The Administrator may not process data for direct marketing purposes in case of an effective objection in this regard by the data subject.

Determination, investigation, or defense of claims that the Administrator may raise or that may be raised against the Administrator in connection with the Contest. Article 6(1)(f) of the GDPR Regulation (legitimate interest) - processing is necessary for the purposes arising from the legally justified interests of the Administrator – consisting of the determination, investigation, or defense of claims that the Administrator may raise or that may be raised against the Administrator The data are stored for the period of existence of the legally justified interest pursued by the Administrator, but no longer than the period of limitation of claims that can be raised against the Administrator (the basic limitation period for claims against the Administrator is six years).


5.6. It is necessary for the Administrator to use the services of external entities. The Administrator only uses the services of such processors who provide sufficient guarantees of the implementation of appropriate technical and organizational measures so that the processing complies with the GDPR and protects the rights of the persons whose data are concerned. The Administrator transfers data only when it is necessary to achieve a given data processing purpose and only to the extent necessary to achieve it. Personal data of Participants may be transferred to the following recipients or categories of recipients:

5.6.1. Providers of services supplying the Administrator with technical, IT, and organizational solutions that allow the Administrator to conduct business activities (in particular providers of computer software for running a website, email and hosting providers, and providers of software for managing the company and providing technical support to the Administrator) - the Administrator provides the collected personal data of the Participant to the selected supplier acting on his behalf only if and to the extent necessary to realize a given data processing purpose consistent with this section 5 of the Rules.

5.6.2. Providers of accounting, legal, and advisory services providing the Administrator with accounting, legal, or advisory support (in particular an accounting office, a law firm, or a debt collection company) - the Administrator provides the collected personal data of the Participant to the selected supplier acting on his behalf only if and to the extent necessary to realize a given data processing purpose consistent with this section 5 of the Rules.

5.6.3. Carriers / freight forwarders / courier brokers / entities handling the shipping process - in the case of the Contest winner, the Administrator provides the collected personal data of the winner to the selected carrier, freight forwarder, or intermediary carrying out shipments on behalf of the Administrator - to the extent necessary to deliver the prize to the winner.

5.7. Each person has the right to control the processing of data concerning them, contained in the Administrator's data set, and in particular the right to: request supplementation, updating, correction of personal data, temporary or permanent suspension of their processing or their deletion if they are incomplete, outdated, false or collected in violation of the law or they are no longer necessary for the purpose for which they were collected.

5.8. The right to access, rectify, restrict, delete or transfer - the data subject has the right to request the Administrator to access their personal data, rectify it, delete it ("the right to be forgotten") or restrict processing and has the right to object to processing, as well as the right to transfer their data. Detailed conditions for exercising the rights mentioned above are indicated in Articles 15-21 of the GDPR.

5.9. The right to withdraw consent at any time - if the personal data are processed by the Administrator based on the expressed consent (pursuant to Article 6(1)(a) or Article 9(2)(a) of the GDPR), this person has the right to withdraw consent at any time without affecting the lawfulness of processing, which was carried out based on consent before its withdrawal.

5.10. The right to lodge a complaint with the supervisory authority - the person whose data is processed by the Administrator has the right to lodge a complaint with the supervisory authority in the manner and procedure specified in the provisions of the GDPR and Polish law, in particular the Act on the protection of personal data. The supervisory authority in Poland is the President of the Personal Data Protection Office.

5.11. The right to object - the data subject has the right at any time - for reasons related to their particular situation - to object to the processing of their personal data based on Article 6(1)(e) (interest or public tasks) or f) (legitimate interest of the administrator), including profiling based on these provisions. The Administrator is no longer allowed to process these personal data unless he demonstrates the existence of valid legally justified grounds for processing, overriding the interests, rights, and freedoms of the data subject, or grounds for establishing, investigating, or defending claims.

5.12. The right to object to direct marketing - if personal data are processed for direct marketing purposes, the data subject has the right at any time to object to the processing of their personal data for such marketing, including profiling, to the extent that the processing is related to such direct marketing.

5.13. To exercise the rights referred to in this section 5 of the Rules, you can contact the Administrator by sending an appropriate message in writing or by email to the Administrator's address indicated at the beginning of the Rules.

6. COMPLAINT PROCEDURE

6.1. Complaints related to the Contest may be submitted by the Participant, for example, via email to: [email protected].

6.2. It is recommended to provide in the description of the complaint as much information and circumstances regarding the subject of the complaint as possible, in particular the type and date of occurrence of the irregularity and contact details - this will facilitate and expedite the consideration of the complaint by the Organizer.

6.3. The Organizer will respond to the complaint immediately, no later than within 14 days from the day of its submission.
