    TERMS AND CONDITIONS OF THE PROLOGIC+ CONTEST March 2026

    1. GENERAL PROVISIONS

    1.1. The Organizer of the Contest is ŁUKASZ PAWLIK conducting business under the name ROCKWORLD ŁUKASZ PAWLIK, registered in the Central Registration and Information on Business Activity of the Republic of Poland, maintained by the minister competent for economic affairs, with the following details: business address and mailing address: ul. Jana Kochanowskiego 21, 48-130 Kietrz, NIP 7481388948, REGON 532429748, email address: [email protected].

    1.2. The Contest is organized in the Organizer’s Online Store available at: www.rockworld-carpshop.com and in the Organizer's Stationary Store located at: ul. Mikołaja 9a, 47-400 Racibórz.

    1.3. A Contest Participant can be a natural person who expresses the desire to participate by submitting an entry in accordance with the Contest Terms and Conditions.

    1.4. Participation in the Contest and providing information and data related to participation, including personal data specified in the Terms and Conditions, is voluntary but necessary for proper conduct of the Contest.

    1.5. The prize sponsor in the contest is the Organizer.

    2. DEFINITIONS:

    2.1. Terms used in these Terms and Conditions mean:

    2.1.1. CIVIL CODE – the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).

    2.1.2. CONTEST COMMITTEE – a committee appointed by the Organizer consisting of 3 persons to ensure proper organization and conduct of the Contest, in particular to select the Contest winner.

    2.1.3. CONTEST – this contest organized by the Organizer according to these Terms and Conditions.

    2.1.4. ORGANIZER – ŁUKASZ PAWLIK conducting business under the name ROCKWORLD ŁUKASZ PAWLIK, registered in the Central Registration and Information on Business Activity of the Republic of Poland, maintained by the minister competent for economic affairs, with the following details: business address and mailing address: ul. Jana Kochanowskiego 21, 48-130 Kietrz, NIP 7481388948, REGON 532429748, email address: [email protected].

    2.1.5. TERMS AND CONDITIONS – these Contest Terms and Conditions.

    2.1.6. ONLINE STORE – the Organizer’s online store available at: www.rockworld-carpshop.com.

    2.1.7. STATIONARY STORE – the Organizer’s stationary store located at: ul. Mikołaja 9a, 47-400 Racibórz.

    2.1.8. PARTICIPANT – a natural person who participates in the Contest and additionally meets the requirements specified in point 3 of the Contest Terms and Conditions.

    2.1.9. CONTEST TASK – the task the Participant must complete by answering the question: "Prologic Inspire Daddy Long 8 Leg Bedchair for me is...." when placing an order in the Online Store or making a purchase in the Stationary Store.

    3. CONDITIONS FOR PARTICIPATION IN THE CONTEST

    3.1. Participation in the Contest is voluntary and free of charge.

    3.2. Entry into the Contest is made by purchasing any products of the Prologic brand, consenting to participate in the contest, and completing the Contest Task during the order process in the Online Store or when making a purchase in the Stationary Store.

    3.3. The Contest Task must be completed independently by the Participant, be an original work that has not been previously published, including on the Internet. By completing and submitting the Contest Task, the Participant confirms they hold full personal and property copyrights to it.

    3.4. Participants are prohibited from submitting unlawful content, especially in relation to the Contest Task. Content submitted, including within the Contest Task, must comply with the law and good manners, respect personal rights and copyrights, intellectual property of the Organizer and third parties, and must not contain vulgar, offensive language or violate social coexistence norms.

    3.5. Employees and collaborators of the Organizer and other persons involved in preparing or organizing the Contest, as well as their immediate family members, are excluded from participation. Immediate family members include ascendants, descendants, siblings, spouses, parents of spouses, and persons in an adoption relationship.

    4. CONTEST RULES AND CONDITIONS

    4.1. The Contest runs from March 3, 2024, to April 5, 2026.

    4.2. To select the Contest winner and ensure proper conduct of the Contest, the Committee will freely choose the winning Contest Task based on its discretion, considering relevance, compliance with the Contest theme, originality, and interest of the Participant's submission.

    4.3. One winner will be selected, who will be awarded by the Contest Committee with a Prologic Inspire Daddy Long 8 Leg Bedchair fishing rod valued at 402 USD.

    4.4. The Contest result will be announced within 14 days after the Contest ends by publishing the information in the appropriate section of the Organizer’s Online Store. Additionally, the winner will be notified by the Organizer via email or phone using the contact details provided.

    4.5. If the Organizer cannot obtain the necessary data to deliver the prize or does not receive a response from the Participant after contacting them, the Committee reserves the right to select an alternative Participant to receive the prize.

    4.6. The Organizer will contact the winner promptly, but no later than 14 days after the Contest ends.

    4.7. The winner may waive the right to the prize but may not transfer the prize to a third party or request cash or any other form of compensation in exchange.

    4.8. The prize will be delivered to the Contest winner by courier at the address provided within 21 days from the announcement of the Contest results at the Organizer’s expense.

    4.9. If the prize is subject to taxation, the Contest winner will receive an additional cash prize equivalent to the tax amount the winner is obliged to pay due to winning the Contest. This additional cash prize will not be paid out but will be allocated to cover the lump-sum tax under Article 30(1)(2) of the Personal Income Tax Act of July 26, 1991 (Journal of Laws of 2018, item 1509, as amended). The tax will be deducted by the Organizer and paid to the relevant tax office.

    5. PRIVACY POLICY

    5.1. The data controller of the personal data processed in connection with these Terms and Conditions is the Organizer (hereinafter: "Controller"). Personal data are processed in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter "GDPR."

    5.2. The Controller processes personal data for purposes, periods, and based on principles set out in this section. Providing personal data is voluntary, but failure to provide data necessary for using the Contest will result in inability to participate. The Controller takes special care to protect the interests of data subjects and ensures that collected data are: (1) processed lawfully; (2) collected for specified, legitimate purposes and not further processed incompatibly with those purposes; (3) accurate and adequate for the purposes of processing; (4) stored in a form allowing identification of data subjects no longer than necessary; and (5) processed securely with appropriate technical and organizational measures to protect against unauthorized or unlawful processing and accidental loss, destruction, or damage. The Controller implements appropriate technical and organizational measures considering the nature, scope, context, and purposes of processing as well as the risk to rights and freedoms of individuals.

    5.3. The Controller may process personal data where at least one of the following applies: (1) the data subject has consented to processing for specific purposes; (2) processing is necessary for the performance of a contract or pre-contractual measures; (3) processing is necessary for compliance with a legal obligation; or (4) processing is necessary for the legitimate interests pursued by the Controller or a third party, except where overridden by the interests or fundamental rights of the data subject.

    5.4. The specific legal bases for processing Participants’ personal data by the Controller are specified in the following clause regarding particular purposes of data processing.

    5.5. The Controller may process personal data for the following purposes, on the following legal bases, and for the following durations:

Data are stored for the time necessary to conduct the Contest, deliver prizes to Participants, terminate the agreement, or expire rights and obligations of the Organizer and Participants.
    Direct marketing Article 6(1)(f) GDPR (legitimate interest) – processing is necessary for the Controller’s legitimate interests.

    Data are stored for the duration of the legitimate interest pursued by the Controller, but not longer than the limitation period for claims related to the Controller’s business activities. The limitation period is defined by law, particularly the Civil Code (basic limitation period is three years for claims related to business activities).

    The Controller cannot process data for direct marketing if the data subject objects effectively.

    Establishing, pursuing, or defending claims related to the Contest Article 6(1)(f) GDPR (legitimate interest) – processing is necessary for the Controller’s legitimate interests of establishing, pursuing, or defending claims. Data are stored as long as the legitimate interest exists, but not longer than the limitation period for claims, which is generally six years.


    5.6. The Controller uses external service providers who guarantee adequate technical and organizational measures to ensure compliance with GDPR and protect data subjects’ rights. Data are shared only when necessary for the specific processing purpose and only to the extent required. Recipients or categories of recipients may include:

    5.6.1. service providers supplying technical, IT, and organizational solutions enabling the Controller’s business operations (e.g., software providers for the website, email and hosting providers, and software for company management and technical support) – data are shared only as necessary for the processing purposes outlined in this section.

    5.6.2. accounting, legal, and advisory service providers supporting the Controller (e.g., accounting offices, law firms, debt collection companies) – data are shared only as necessary for the processing purposes outlined in this section.

    5.6.3. carriers / freight forwarders / courier brokers / shipping service providers – in case of the Contest winner, the Controller shares personal data with selected carriers or intermediaries for prize delivery purposes only.

    5.7. Data subjects have the right to control processing of their data, including the right to request completion, update, correction, temporary or permanent suspension, or deletion of incomplete, outdated, inaccurate, unlawfully collected, or no longer necessary data.

    5.8. Data subjects have the right to access, rectify, restrict, delete ("right to be forgotten"), object to processing, and data portability, according to Articles 15-21 GDPR.

    5.9. The right to withdraw consent at any time – if data are processed based on consent (Articles 6(1)(a) or 9(2)(a) GDPR), data subjects can withdraw consent at any time without affecting lawfulness of prior processing.

    5.10. The right to lodge a complaint with a supervisory authority – data subjects may file complaints to the relevant data protection authority. In Poland, this is the President of the Personal Data Protection Office.

    5.11. The right to object – data subjects may object at any time, for reasons related to their particular situation, to processing based on Article 6(1)(e) or (f) GDPR, including profiling based on those provisions. The Controller must then cease processing unless overriding legitimate grounds or claims exist.

    5.12. The right to object to direct marketing – data subjects may object to processing for direct marketing purposes at any time, including profiling to the extent related to such marketing.

    5.13. To exercise these rights, contact the Controller by sending a written or electronic message to the address specified at the beginning of these Terms and Conditions.

    6. COMPLAINT PROCEDURE

    6.1. Contest-related complaints may be submitted, for example, via email to: [email protected].

    6.2. It is recommended to provide as much information as possible in the complaint, including the type and date of the irregularity and contact details to facilitate and expedite processing.

    6.3. The Organizer will respond to the complaint promptly, no later than within 14 days of receipt.

    6.4. The complaint procedure does not limit the Participant's right to seek claims before a competent common court.

    7. FINAL PROVISIONS

    7.1. Polish law governs the organization of the Contest.

    7.2. The Organizer declares that the Contest is not a game of chance, raffle, mutual bet, promotional lottery, a game determined by chance, or any other form defined by the Act of November 19, 2009, on gambling (Journal of Laws of 2009 No. 09, item 1540).

    7.3. The Organizer reserves the right to amend the Terms and Conditions for valid reasons, such as changes in the law affecting the implementation of these Terms and Conditions.

    7.4. Matters not regulated herein are governed by the Civil Code and other applicable Polish law provisions.
